Emulators Legal?
Ok I know nothing about the legality of emulators, so are they legal?
(I wouldnt think so, but I want confirmation)
and if it is legal...
I'd rather put Halo 2 on my pc, without buying it for Visa....
I got Halo 2 for Xbox and on live so I dont need Multiplayer.
I just want to mod it, without modding my box.
In short
is an xbox emulator legal?

The emulators themselves arn't illegal but the ROMs that you download are. You must delete the roms within 24 hours or it will become illegal.
At the moment however, there are no good Xbox emulators that would run Halo 2 (I dont even know if there is a rom for that yet). All the emulators out now are crap so you might as well:
a.) Wait 3 years until a decent one comes out
or
b.) Just get Vista and H2

Now if you were to create the copy yourself you wouldn't be breaking any rules (Once again, provided you don't distribute)GameFAQs wrote:Is it legal to download a copy of a game I own?
No. Even if you own the original game, you are not entitled to download a copy of it. Copyright law clearly states that the only copy of software you are entitled to is the one you make yourself.

Re: Emulators Legal?
I've heard if you own a copy of the game, the ROM is not illeagal (I heard it from attack of show on G4.). The USA considers it stealing if you don't have a copy. It depends on what country you live in.Akira Kurosawa wrote:Ok I know nothing about the legality of emulators, so are they legal?

I like pie!
There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a ROM from the Internet.
This is all from Nintendo's site. They claim that emulators are illegal once at the end. Which is funny because their previous wordings show that they know that they aren't.Game copiers enable users to illegally copy video game software onto floppy disks, writeable compact disks or the hard drive of a personal computer. They enable the user to make, play and distribute illegal copies of video game software which violates copyrights and trademarks. These devices also allow for the uploading and downloading of ROMs to and from the Internet. Based upon the functions of these devices, they are illegal.
So:Generally yes [Emulators are legal] However, there have been emulators that used copyrighted BIOS code internally; those have generally found to have been illegal when distributed with that BIOS.
Roms-> no, never. You have to copy yourself, and can only have one copy. Downloading a copy of a game you have is still illegal.
Emulators-> Most of the time. PSX emulators are notorious for using real psx BIOS's but not packaging them with the game. The BIOS copy itself is illegal. And a lot of newer emulators require the BIOS as the emulator uses it to run games. NES/SNES and other emulators usually don't contain BIOS and are pure observant, biosless emulation and are thus legal. But you can only play games you backup.
Also 24 hour rule is fake. Although if you do try this, I guarantee you that if someone does track you down and prosecute you, the only evidence is your ISP records. But they won't do that anyway.
BUT:
Like I said. You'll never get caught as long as you are careful and aren't distributing tons of products. Downloading 4000+ ROMS, won't get you caught. Burning and distributing 14 retail new console games/movies without knowing how to conceal yourself might just get you caught.
